Chatime's Taiwanese franchisor seizes control from Malaysian sole franchisee

KUALA LUMPUR (Jan 6): Taiwan-based La Kaffa International Ltd, the franchisor of Chatime beverage outlets, will terminate its contract with its sole Malaysian franchisee due to disagreement on royalty and ingredient sources.

La Kaffa chairman Henry Wang said the company would terminate its contract with Loob Holdings Sdn Bhd with immediate effect. Wang said La Kaffa would assume management of all Chatime stores in Malaysia.

“Food and beverage products can easily be substituted. Businesses must continue to reinvent themselves by introducing new brands and products based on market demand to attract customers,” he said at a press conference here today.

La Kaffa executive vice president Teresa Wang said: “Due to disagreements with Loob Holdings, we have no choice but to make this painful decision.”

Chatime entered the Malaysian market in 2010. According to Chatime’s website, the franchise was founded in 2005.

Today, there are over 800 Chatime outlets across countries, including China, Australia and the U.S., the website indicated.

Loob to seek legal advice on purported end to Chatime franchise pact

KUALA LUMPUR: Loob Holdings Sdn Bhd, operator and owner of Chatime outlets in Malaysia, will seek legal advice in response to news of a purported termination of the franchise agreement between it and La Kaffa International of Taiwan.

In a statement on Friday, Loob chief executive officer Bryan Loo said although the franchisor owned the brands, all Chatime outlets in Malaysia were owned and operated by the company, either through direct ownership, sub-franchisees or joint-venture with sub-franchisees.

He said while waiting for the legal process, all 165 Chatime outlets in Malaysia would be operating as usual under master franchisee Loob Holdings.

“Let me assure our Malaysian customers that our outlets would continue to offer the same quality products and excellent service that the company has built up over the past six years,” he said.

Earlier, La Kaffa’s chairman, Henry Wang, has announced the termination of Loob Holdings’ Chatime master franchisor contract due to disagreements in the direction of business operations.

Wang said it would take over the Chatime business operations in Malaysia and assured franchisees they would continue to receive support from the company.

All Malaysian Chatime outlets operating as usual

Kuala Lumpur, Fri. – All 165 Chatime outlets in Malaysia are operating as usual under master franchisee Loob Holding Sdn Bhd (the Company).

Bryan Loo, CEO of Loob Holding, said this in response to news of a purported termination of the franchise agreement between Loob Holding and La Kaffa International of Taiwan (‘La Kaffa’) by La Kaffa which was released in the media today.

Loo said the company will respond to the matter upon seeking legal advice.

During this process, all Chatime outlets will operate as usual.

“Let me clarify that although the franchisor owns the brand, all Chatime outlets in Malaysia are owned and operated by the company, either through direct ownership, by sub-franchisees or in joint-venture with sub-franchisees.

“Let me assure our Malaysian customers that all our outlets continue to offer the same quality products and excellent service that the Company has built up over the past six years.

“In fact, many of our customers refer to Chatime as a brand born in Taiwan but raised in Malaysia,” he added.

The Company is currently seeking legal advice on the purported termination and will keep all stakeholders updated accordingly.

Malaysian Chatime franchisees throw support behind master franchisee Loob

KUALA LUMPUR: Franchisees of Chatime Malaysia are throwing their support behind master franchisee Loob Holding Sdn Bhd which has held the Chatime franchise in Malaysia for six years now.

On Friday, brand owner and franchisor Taiwan-based La Kaffa International Co Ltd chairman Henry Wang said they have terminated a master franchisee agreement with Loob following disagreements over ingredients and royalties.

Loob in a statement issued after the announcement last Friday, however, said it remains the master franchisee of Chatime in Malaysia and is seeking legal advice on the purported contract termination. It said that although La Kaffa owns the brand, all 165 Chatime outlets in Malaysia are owned and operated by Loob, either through direct ownership, joint ventures or franchisees.

Franchisees SunBiz spoke to attributed the success of Chatime in Malaysia to Loob, founded by entrepreneur Bryan Loo, given that the brand is less well known in Taiwan. They praised Loob for being attentive to franchisees and providing good business support, especially in marketing.

“Whatever that’s going to happen next, I think all of us are behind him (Loo). We will follow him. He made Chatime big here and we have faith in him,” a Chatime Publika franchisee said.

The franchisee said it is too soon to tell whether business has been affected by news of Loob’s purported contract termination. Another outlet noted that business is still all right.

“I have other franchises and I feel that Loob really supports their franchisees a lot,” said the franchisee, commending Loob’s marketing efforts that range from social media marketing campaings to having joint promotions.

“We know what Loob’s plans are and what they’re going to do next and all we need to do is to stick to them,” said the Chatime Publika franchisee.

Another franchisee who runs a Chatime outlet in the Klang Valley via a joint venture with Loob said a meeting is expected to be called by Loob this week to explain matters to franchisees.

Besides Chatime, Loob manages a diverse portfolio of food and beverage brands in Malaysia, including Tino’s Pizza, Soda Xpress, Llaollao and Gindaco, with technology start-up investments in the pipeline.

On Friday, La Kaffa chairman Henry Wang said in a press conference that it had terminated the master franchisee contract with Loob Holding and will take over the Malaysian Chatime business operations and development with immediate effect.

"After much communication, an agreement has not been reached and we have decided to terminate the contract with Loob. To the franchisees, rest assured that they will continue to receive the full support from the company (La Kaffa). We also welcome anyone who is interested in joining the Chatime family to continue providing Malaysian consumers with high-quality products and services,” he said.

La Kaffa executive vice-president Teresa Wang said it has been preparing to take back the Chatime franchise in Malaysia from a year ago. “Chatime is a global brand and as long as we follow the brand strategy, we still have confidence in the Malaysian market.”

Chatime is a Taiwanese franchise founded in 2005 with over 800 retail outlets in China, Australia, Dubai, Canada, the UK, the US and others.

La Kaffa, which operates food and beverage brands in over 30 countries, plans to set up its first regional operation centre in Malaysia in the first quarter which will provide a platform to launch local Malaysian delicacies and food & beverage brands to the world.

Malaysia’s Chatime outlets to be replaced with local brand after franchise dispute

KUALA LUMPUR: Mention bubble tea in Malaysia and Chatime is one of the brands that would come to mind. It’s a Taiwanese teahouse chain that has 165 outlets in Malaysia but all of them would soon be replaced by a new beverage franchise.

This is after Chatime’s franchiser La Kaffa abruptly terminated its agreement with Malaysia’s Loob Holding - its master franchisee in its biggest market outside Taiwan.

Loob Holding CEO Bryan Loo said the company, which brought Chatime to Malaysia in 2010, was informed of the termination in a meeting on Jan 5. The next day, La Kaffa held a press conference in Kuala Lumpur announcing it would be taking over the Malaysian Chatime business operations and development with immediate effect due to disagreements over direction.

“Whatever dispute could have easily been sorted out through the franchise agreement in the manner of arbitration in Singapore,” Mr Loo told Channel NewsAsia. “It should not have come to the extent … (of) unilaterally terminating our franchise rights for Malaysia. This is something beyond our imagination.”

According to Mr Loo, under his company, Chatime outlets in Malaysia make up more than 50 per cent of Chatime’s global revenue.

Channel NewsAsia has tried to contact La Kaffa for comment.

“WE WILL NOT SUDDENLY SELL MEE HOON”

Loob Holding said it felt ambushed by the decision, with 24 years left to their contract and more than 1,000 jobs on the line.

A legal battle may ensue as Loob has lodged a police report against La Kaffa. But for now, it has agreed to the termination and said it will be moving forward, replacing every Chatime outlet with its own brand which it describes as “born in Malaysia and raised for the world”.

But will this new brand serve bubble tea?

Said Mr Loo: "I would love to emphasise we’re a beverage company. We won’t pivot too much away from beverages. We will not suddenly sell fried mee hoon or something.

“It can be a different format of beverages, maybe specialising in (tea with fresh fruit) … so it’s an upgraded experience when it comes to quality products.”

Loob said its sub-franchisees and joint venture partners are all on board with the new brand.

La Kaffa could still restart the Chatime brand in Malaysia, but Mr Loo said his company is ready to take on the challenge.

“If they enter the market, we guarantee we will open next to them,” he said.
